1. Introduction

Welcome to AusomeFriend, an autism parenting support platform owned and operated by Ausome Software Publishing (referred to as "we," "us," "our," or "AusomeFriend").

These Terms of Use ("Terms") govern your access to and use of the AusomeFriend mobile application and related services (collectively, "Services").

By using AusomeFriend, you agree to these Terms. If you do not agree, do not use the Services.

• 24/7 AI Companion: Conversational support for autism parenting challenges. Provides peer-informed strategies and educational information—NOT medical advice.
• Stress Management: Coping strategies and emotional support for parents—NOT mental health treatment.
• Educational Content: Information about autism, child development, and evidence-based approaches—NOT medical guidance.

3.2 Tracking & Organization Tools

• Behavior Logging: Personal journal for tracking behaviors, triggers, and strategies—NOT clinical documentation.
• Pattern Recognition: Historical pattern analysis of your logged data—NOT predictive diagnosis.
• Video Analysis: Observational insights from uploaded videos—NOT diagnostic assessment.
• Therapy Notes Digitization: OCR processing of handwritten notes—NOT creation of clinical records.
• Calendar & Milestones: Scheduling and developmental tracking—NOT medical monitoring.

3.3 Developmental Observation Tools

• Quick Development Check: Brief parent observation questionnaire—NOT diagnostic screening.
• ACAS Questionnaire: Comprehensive parent observation tool—NOT clinical assessment.
• BDI Milestone Tracker: Developmental milestone tracking—NOT medical evaluation.

All questionnaires are for parent observation only. Results may help you identify areas to discuss with qualified healthcare professionals. They do NOT diagnose medical conditions.

3.4 Therapist Finder

Location-based search of developmental pediatricians and therapists in the Philippines. Provides contact information only—NOT medical referrals or endorsements.

4. Eligibility

You must be at least 18 years old to use AusomeFriend.

By using the app, you confirm that:

• You are 18 years of age or older
• You have the legal authority to use the Services
• You are the parent or legal guardian of any child whose information you provide
• You are capable of forming a binding legal agreement

5. Account Registration

5.1 Creating an Account

To use AusomeFriend, you must create an account using:

• Email and password, or
• Google Sign-In

You are responsible for maintaining the confidentiality of your account credentials.

5.2 Accurate Information

You agree to:

• Provide accurate, current, and complete information
• Update your information promptly when it changes
• Notify us immediately of any unauthorized access

5.3 Account Security

You are solely responsible for:

• All activities under your account
• Maintaining password security
• Unauthorized use of your account

6. User Conduct & Prohibited Uses

You agree NOT to:

• Use the app for any illegal purpose
• Upload harmful, offensive, or inappropriate content
• Harass, abuse, or harm others
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the app
• Use automated systems (bots) to access the Service
• Interfere with or disrupt the Service
• Share your account credentials with others
• Use the Service to diagnose or treat medical conditions
• Rely on AI-generated content as medical advice

7. Child Data & Parental Consent

7.1 Parental Authority

By entering information about a child, you confirm that:

• You are the parent or legal guardian of that child
• You have the legal authority to provide this information
• You consent to the collection and use of this information as described in our Privacy Policy

7.2 Sensitive Information

Child information you may provide includes:

• Name, date of birth, age
• Developmental milestones
• Behavioral observations
• Videos (temporarily processed for analysis, then automatically deleted)
• Therapy notes and progress

7.3 Your Rights & Control

You have the right to:

• View all child data in the app at any time
• Export data (PDF reports, CSV files)
• Delete child profiles and associated data
• Withdraw consent for data processing

8. AI-Powered Features

8.1 AI Companion

Our AI companion provides:

• Peer-informed parenting support
• Educational information about autism and child development
• Stress management strategies
• Suggestions based on evidence-based approaches (ABA, developmental psychology)

The AI companion does NOT:

• Provide medical advice or diagnosis
• Replace consultation with healthcare professionals
• Have access to your child's complete medical history
• Make treatment decisions

8.2 Pattern Recognition

Pattern recognition analyzes historical data you've logged to identify:

• Recurring behaviors
• Common triggers
• Time-based patterns
• Effective strategies

Pattern recognition does NOT:

• Predict future medical outcomes
• Diagnose medical or behavioral conditions
• Provide clinical certainty
• Replace professional behavioral analysis

8.3 Video Analysis

When you upload a video:

• AI analyzes visible behaviors and provides observational insights
• Video is processed immediately
• Video is automatically and permanently deleted from our servers after analysis
• Only the text-based observations are retained

Video analysis does NOT:

• Provide medical diagnosis
• Replace developmental pediatrician evaluation
• Assess psychological or medical conditions
• Provide treatment recommendations

8.4 AI Limitations

You acknowledge that AI-generated content:

• May contain errors or inaccuracies
• Is not a substitute for professional judgment
• Should be verified with qualified professionals before implementation
• Is for educational and informational purposes only

9. Credits System & Pricing

9.1 How Credits Work

AusomeFriend uses a credit-based system:

• Credits are purchased in packages
• Credits are consumed when using certain features (AI conversations, video analysis, assessments)
• Credits do not expire
• Credits are non-transferable
• Unused credits remain in your account

9.2 Credit Pricing

Current pricing (subject to change):

• Starter: ₱59 - 70 credits
• Family: ₱199 - 240 credits
• Value: ₱399 - 550 credits
• Premium: ₱799 - 1,150 credits

9.3 Free Features

Some features are available for free:

• Account creation
• Child profile setup
• Basic behavior logging (text notes)
• Quick Development Check (one-time)
• Calendar and milestone tracking
• Therapist finder

9.4 Price Changes

We reserve the right to modify pricing at any time. Changes will not affect credits already purchased.

10. Payment, Billing & Refunds

10.1 Payment Processing

Payments are processed securely through:

• Philippines: PayMongo (credit cards, GCash, bank transfers)
• iOS: Apple App Store
• Android: Google Play Store

We do not store your payment card details on our servers.

10.2 No Refunds Policy

All credit purchases are final and non-refundable, except:

• Where required by law
• Duplicate charges (technical error)
• Unauthorized transactions (fraud)

If you believe you're entitled to a refund under these exceptions, contact us at support@ausomefriend.com within 7 days of the purchase.

10.3 Acknowledgments

By purchasing credits, you acknowledge:

• Purchases are processed securely through payment providers
• We do not store your payment card details
• All purchases are final and non-refundable unless required by law
• Credits are used immediately when actions are performed
• Fraudulent or unauthorized transactions may result in account suspension

11. Intellectual Property

All rights to:

• The AusomeFriend mobile application
• Behavioral taxonomy and tracking system
• AI models, personas, and prompts
• ACAS and BDI assessment systems
• User interface, user experience, and design
• Graphics, logos, and branding
• Audio responses and features
• All source code and algorithms

…belong exclusively to Ausome Software Publishing.

You may not copy, modify, distribute, sell, or create derivative works from our content, code, or systems without explicit written permission.

12. User-Generated Content

12.1 Your Content Ownership

You retain ownership of all data you create and upload:

• Behavior logs and observations
• Videos (before automatic deletion)
• Notes and journal entries
• Assessment responses
• Calendar events

12.2 License to Use Your Content

By using the app, you grant us a limited, revocable license to:

• Process your content through our AI systems
• Analyze patterns and generate insights
• Store content as required to provide services
• Create anonymized, aggregated statistics (no personal identification)

12.3 What We Don't Do

We do NOT:

• Sell your content to advertisers or third parties
• Share identifiable personal information publicly
• Use your content for marketing purposes without consent
• Transfer ownership of your content

13. Data Use and Privacy

Information you provide to AusomeFriend, including behavior logs, conversations, and assessment responses, is subject to our Privacy Policy.

We use this information to:

• Provide and improve our services
• Train and improve AI models
• Generate personalized insights
• Create anonymized, aggregated statistics

You must read and agree to the Privacy Policy to use AusomeFriend.

13A. Health-Related Data Collection & Use

13A.1 What Health-Related Data We Collect

AusomeFriend collects information you voluntarily provide, including:

• Behavioral observations: Behaviors, triggers, and environmental factors you log
• Developmental information: Milestone tracking and questionnaire responses
• Parental stress and mental health: Information you share about your experiences and challenges
• Video content: Videos you upload for analysis (temporarily processed, then deleted)
• Conversation logs: Your interactions with AI companion

13A.2 How We Use Health Data

We use your information to:

• Provide personalized AI responses and suggestions
• Identify patterns in behavior tracking
• Generate insights and summaries
• Improve our AI models and services
• Create anonymized, aggregated statistics (no personal identification)

13A.3 We Do NOT:

• Sell your health information to advertisers
• Share identifiable health data with third parties (except as legally required)
• Use your data for marketing purposes
• Share your information with insurance companies
• Create medical records or clinical documentation

You have the right to:

14. Termination & Suspension

14.1 Termination by You

You may terminate your account at any time by:

• Requesting account deletion through the app settings
• Contacting us at support@ausomefriend.com

14.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You misuse the AI or upload harmful content
• You attempt to bypass payment systems
• You endanger the privacy or safety of others
• Your account remains inactive for extended periods
• We're required to do so by law

14.3 Effect of Termination

Upon termination:

• You lose access to your account and data
• Unused credits are forfeited (no refunds)
• We delete retained data as required by law
• Child profiles, logs, and uploaded content are removed
• Some data may be retained for legal compliance purposes

15. Medical Disclaimer & Health Information

15.1 Developmental Questionnaires

The developmental tracking tools (Quick Development Check, ACAS, BDI) are parent observation questionnaires only. They are NOT medical assessments or diagnostic instruments.

• Not diagnostic: Cannot diagnose autism, developmental delays, or any medical condition
• Screening only: May help identify areas to discuss with professionals
• Not validated for diagnosis: Results do not replace professional evaluation
• Parent observation: Based on your observations, not clinical assessment

ONLY qualified healthcare professionals (developmental pediatricians, psychologists) can diagnose developmental conditions.

15.2 AI-Generated Content

All AI-generated responses, suggestions, and insights are for educational and informational purposes only.

• AI responses may contain errors or inaccuracies
• AI cannot replace professional judgment
• AI does not have access to your child's complete medical history
• AI suggestions should be discussed with healthcare providers before implementation
• AI is not a licensed healthcare professional

15.3 Pattern Recognition & Behavior Tracking

Pattern recognition features identify historical patterns in your logged data. They do NOT:

• Predict future behaviors with medical certainty
• Diagnose behavioral or medical conditions
• Replace functional behavior analysis by qualified professionals (BCBAs)
• Provide clinical recommendations
• Guarantee specific outcomes or results

15.4 Video Analysis

Video analysis provides observational insights only. It does NOT:

• Provide medical diagnosis
• Replace developmental pediatrician evaluation
• Assess medical or psychological conditions
• Provide treatment recommendations
• Substitute for ADOS or other standardized assessments

15.5 General Disclaimers

AusomeFriend is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

We do not guarantee:

• Accuracy of AI outputs or suggestions
• Improvement in child behavior or development
• Suitability for any particular child's needs
• Continuous availability or error-free operation
• Freedom from bugs, errors, or interruptions
• That the Service will meet your expectations

15.6 Qualified Professionals Include:

• Developmental Pediatricians
• Child Psychologists
• Board Certified Behavior Analysts (BCBAs)
• Occupational Therapists (OTs)
• Speech-Language Pathologists (SLPs)
• Special Education Teachers
• Licensed Clinical Social Workers

16. Limitation of Liability

16.1 Use At Your Own Risk

You use AusomeFriend at your own risk. To the maximum extent permitted by law, AusomeFriend, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Service
• Any actions you take based on information provided by AusomeFriend
• Any AI-generated content or recommendations
• Any errors, omissions, or inaccuracies in content
• Any decisions made regarding your child's care, health, education, or wellbeing
• Any loss of data or content
• Any misuse of the Service by you or others
• Any reliance on developmental questionnaires or pattern recognition
• Any third-party services or links

16.2 Maximum Liability

To the extent permitted by law, AusomeFriend's total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to AusomeFriend in the 12 months preceding the claim, or ₱5,000 PHP (approximately $100 USD), whichever is greater.

16.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless AusomeFriend, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you upload or submit
• Any actions you take based on information from AusomeFriend
• Any decisions you make regarding your child's care, health, or education based on Service content
• Your breach of any representation or warranty
• Your violation of applicable laws

18. Updates to the Terms

We may modify these Terms at any time. We will notify you of material changes via:

• Email to your registered address
• In-app notification
• Notice on our website

Continued use of the Services after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and may terminate your account.

We recommend reviewing these Terms periodically to stay informed of any changes.

19. Governing Law

These Terms are governed by the following laws:

19.1 For Users in the Philippines

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

19.2 For Users in the United States

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

19.3 For Users Outside Philippines and United States

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.

Disputes will be resolved through amicable discussion before any legal action.

20. Dispute Resolution

20.1 Informal Resolution

Before filing any claim, you agree to contact us at support@ausomefriend.com to attempt to resolve the dispute informally.

20.2 For U.S. Users - Arbitration

For users in the United States, any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except where prohibited by law.

You and AusomeFriend agree to waive the right to a jury trial or to participate in a class action.

20.3 For All Other Users

For users outside the United States, disputes will first be attempted to be resolved through amicable discussion. If resolution is not possible within 30 days, disputes shall be submitted to the appropriate courts of the Republic of the Philippines.

20A. Regulatory Status

20A.1 Not a Regulated Medical Device

AusomeFriend is NOT regulated as a medical device by:

• FDA (United States Food and Drug Administration)
• DOH (Philippines Department of Health)
• CE (European Conformity)
• Any other health regulatory authority

We do not claim to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

20A.2 Educational & Supportive Purpose

Our app is intended solely for:

• Parenting support and peer education
• Personal behavior tracking and organization
• Stress management for caregivers
• Facilitating communication with healthcare providers
• Providing information about autism and child development

20A.3 Compliance with App Store Policies

AusomeFriend complies with:

• Google Play health app policies
• Apple App Store health app guidelines
• Data protection regulations (GDPR, CCPA, Philippine Data Privacy Act)
• Consumer protection laws

20A.4 No Medical Claims

We make no claims that AusomeFriend will:

• Diagnose any medical condition
• Treat or cure autism or developmental delays
• Improve child outcomes or development
• Replace professional healthcare services
• Provide medical-grade accuracy or reliability
