Terms of Use

1. Who May Use AusomeFriend

You may use AusomeFriend only if:

• You are 18 years or older, and
• You are a parent, guardian, or authorized caregiver of a child whose data you enter.

Minors are not allowed to create accounts.

2. Purpose of the App

AusomeFriend is designed to support parents and caregivers of autistic or neurodivergent children through:

• Voice-based AI guidance
• Behavior tracking ("Moments")
• Video-based behavioral analysis
• Developmental assessments
• Progress insights and pattern detection
• AI-generated tips and strategies

3. Your Account

You must create an account to use most features. You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us of unauthorized access
• Use the account only for your own children or those you are authorized to care for

You are responsible for all activity under your account.

4. Child Data & Consent

By adding a child profile, you confirm that:

• You are the parent or legal guardian, or
• You have explicit permission to record and store data about that child

You must not add any child's information without proper authority.

5. Behavior Logs, Video Uploads, and Voice Notes

AusomeFriend allows you to record and log sensitive behavioral information, including:

• Text entries
• Voice recordings
• Transcriptions
• Video uploads
• Video-based AI analysis
• ABC (Antecedent, Behavior, Consequence) details

You understand and agree that:

• Uploaded videos are temporarily stored, analyzed, and then deleted automatically
• Audio files are deleted after transcription
• Only written insights remain
• You must not upload content containing unrelated individuals without their consent
• You must not upload harmful, illegal, or explicit content

6. Acceptable Use

You agree not to:

• Misuse or disrupt the Service
• Attempt to reverse-engineer any component
• Upload harmful files (malware, viruses, corrupted data)
• Use the AI features to generate harmful or unsafe content
• Harass, threaten, or impersonate others
• Circumvent credit payments or API limits
• Use the system for non-family or unauthorized data collection
• Use the Services for commercial, clinical, or research purposes without permission

We reserve the right to suspend or terminate accounts that violate these Terms.

7. AI Features and Limitations

AusomeFriend uses AI, including models from OpenAI, to provide guidance, suggestions, and behavioral insights.

You acknowledge that:

• AI outputs may be inaccurate or incomplete
• AI is not a clinician or medical professional
• You must verify information before making care decisions
• AI conversations are stored temporarily to provide continuity

We do not guarantee any result or improvement.

8. Credit System, Payments & Billing

Certain AusomeFriend features require credits (voice logs, video analysis, insights).

By purchasing credits, you acknowledge:

• Purchases are processed securely through PayMongo
• We do not store your payment card details
• All purchases are final and non-refundable, unless required by law
• Credits are used immediately when actions are performed
• Fraudulent or unauthorized transactions may result in account suspension

9. Intellectual Property

All rights to:

• The AusomeFriend app
• Behavioral taxonomy
• AI personas and prompts
• ACAS assessment system
• Visuals, UI/UX, graphics
• Audio responses and features

…belong exclusively to Vibecode / AusomeFriend Project.

You may not copy, modify, distribute, sell, or create derivative works from our content or code.

10. User-Generated Content

You retain ownership of the data you create (logs, videos, notes).

By using the app, you grant us a limited, revocable license to:

• Process
• Analyze
• Generate insights from
• Store (where required)

…your content for the purpose of providing Services.

We do not sell or share your content with advertisers.

11. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, process, and protect your data.

You must read and agree to the Privacy Policy.

12. Termination & Suspension

We may suspend or terminate your account if:

• You violate these Terms
• You misuse the AI or upload harmful content
• You attempt to bypass payment systems
• You endanger the privacy or safety of others
• You request account deletion

Upon termination:

• You lose access to your account and data
• We delete retained data as required by law
• Child profiles, logs, and uploaded content are removed unless retention is legally required

13. Disclaimers

AusomeFriend is provided "as is" and "as available."

We do not guarantee:

• Accuracy of AI outputs
• Continuous availability
• Improvement in child behavior or development
• Freedom from bugs, errors, or interruptions

14. Limitation of Liability

To the fullest extent permitted by law:

AusomeFriend, its creators, developers, and partners are not liable for:

• Any decision you make based on AI suggestions
• Any loss of data
• Any indirect, incidental, special, or punitive damages
• Any misuse of the Service by you or others

Total liability for any claim will not exceed the amount you paid in the last 6 months.

15. Indemnification

You agree to protect, defend, and indemnify AusomeFriend and its team against any claims arising from:

• Your use or misuse of the Services
• Content you upload or submit
• Your violation of these Terms
• Your violation of another person's rights

16. Updates to the Terms

We may modify these Terms at any time.

We will notify you in-app or by email when changes are significant.

Continued use of the Services means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

Disputes will be resolved through amicable discussion before legal action.
